[Registration No. 202201036341 (1482038-A)] (“Tomei”, “our”, “we” or “us”), understand and respect your concerns about privacy. It is our priority to manage and protect your personal data responsibly. The privacy practices of this policy are in compliance with the Personal Data Protection Act 2010 (“PDPA”) in Malaysia. 

Our Privacy Policy is designed to explain how Tomei manages your personal data. This Privacy Policy describes how we will collect, record, use, store, hold, transfer and disclose your personal data. When you visit Tomei’s website or provide us with your personal data whether it be through our website enquiry, membership forms or by another means whatsoever, you accept and consent to the terms of our Privacy Policy.

The terms “Personal Data” shall have the meaning prescribed in the PDPA. Information collected can include but is not limited to name, identification number, email address, contact details, demographic information, preferences and payment details if a transaction is carried out. The provision of personal data by you to use may be indicated by Tomei as compulsory or obligated in order for Tomei to perform relevant purposes as stated in the section below and Tomei may not be able to perform such purposes of you fail to supply your personal data. 

Personal data is collected through yourself by giving such information to us either through our stores, enquiry and membership forms, online, media, including but not limited Tomei’s website, applications, platforms or when you make any purchase transaction with us and through various sources including without limitation:- 

• Publicly available sources such as searches conducted at government authorities or credit reporting agencies; and/or 

• Any other sources that are permitted by law or not otherwise restricted.

Such personal data will be collected, used, and/ or processed by Tomei for one or more of the following  purposes: 

• Membership registration, verification and entitlement to membership privileges; 

• Customer account registration and access to Tomei’s websites, applications, platforms, products and/or services; 

• Personalization and/or improvement of Tomei’s websites, applications, platforms, products and/or services; 

• Providing our products and services; 

• Product reservation, services and repairs; 

• Customer enquiries and requests; 

• Notification, marketing and/or participation of new showrooms, events, contests, lucky draws, offers, products and services and/or other activities organized by us; 

• Operation and management of our company and business including those of our related companies and associated companies; 

• Updates and consolidation of our records;

We will do our utmost best to protect the security and integrity of your personal data. Tomei has the appropriate technical, administrative and physical capacity to prevent any unauthorized access, collection, use, disclosure, copying, modification and disposal of your personal data. Internal procedures are also put in place requiring our employees and data processors to respect the confidentiality of any personal data held by us. 

Accessing, Correction and Amending Your Personal Data 

Where applicable, we will take reasonable steps to verify the accuracy of your personal data received at the point of collection. However, please note that you are accountable and liable for the accuracy and completion of all personal data submitted by you. You may access, review, update, or modify certain of your personal data that is stored with us. If you have provided your personal data through our stores, enquiry or membership forms, you may request the correction or amendment of your personal data by contacting our customer service department as stipulated below or if you have provided your personal data through our application or platform, you may request the correction or amendment of your personal data through the application or platform. Tomei will use reasonable efforts to comply with your request to access, amend or delete your personal data after receiving your request and the relevant processing fee (if any), to the extent required by law.

Disclosure of Information 

Your personal data may be disclosed by Tomei to the following third parties for one or more of the above purposes in accordance with this Privacy Policy and/or as permitted by the applicable data protection laws:  

• Our related companies, associated companies, agents, partners, affiliates, representatives, service providers, solicitors, accountants, auditors, consultants, financial advisors and other professional advisors; 

• Any party that assists us in processing and/or otherwise fulfilling the products and/or services that we provide to you; 

• Any party as required by any law or any order of any court, tribunal, authority, regulatory body, governmental or statutory or supervisory authority; 

• Any party connected to the enforcement or preservation of any of our rights under your contract and/or arrangement with us;

• Any other parties that are relevant to carry out any of the purposes stipulated herein or our business including those of our related companies and associated companies; and/or

We do not rent or sell your personal data to third parties for their marketing purposes without your explicit consent. 

Your personal data may be transferred to a place outside of Malaysia and you hereby expressly consent to the same. 

Retention of Information 

All your personal data kept by us is stored on our secured servers and/or databases. Your personal data will be retained for as long as it is necessary to fulfill the purpose for which it is collected or for the business or legal purposes in accordance with the applicable laws or any order of any court, tribunal, authority, regulatory body, governmental or statutory or supervisory authority. Should you choose to unsubscribe from our mailing list, please kindly note that all personal data will still be retained in our server and/or databases for as long as it is necessary as the aforementioned. 

Revisions to our Privacy Policy 

This Privacy Notice may be revised from time to time. Notice of any such revision will be given on Tomei’s website and/or by such other means of communication deemed suitable.  

In the event of any conflict between the English version of this Privacy Policy and the Bahasa Malaysia version, the English version shall prevail.
